The Jodi Arias defense is asking the judge to rule on a motion for a lesser charge that would allow Jodi Arias to be out of jail in two years or less if the jury inititially rejects the death penalty charge.
The prosecution had to prove beyond a reasonable doubt that Jodi Arias went to Mesa, Arizona on June 4, 2008 for the purpose of killing Travis Alexander.
There is a lot of circumstantial evidence like gas cans and car rental receipts, but nothing that establishes premeditation beyond a reasonable doubt.
